Delta 8 THC is one of the many cannabinoids found in the hemp plant. When the 2018 Farm Bill passed it federally legalized all hemp products with one exception. All products must contain 0.3% or less Delta 9 THC, the compound traditionally known to cause the psychoactive effects in marijuana.  Since this time extractors have made extraordinary discoveries in hemp cannabinoids, one being Delta 8. This cannabinoid is a close relative of Delta 9 but also distinctly different in chemical composition.

Is Delta 8 THC legal?

According to the 2018 Farm Bill, it is “federally legal”. It states that any hemp products below 0.3% in Delta 9 THC is legal. The Farm Bill never discussed any other THC products. However, several states have opted to make Delta 8 illegal. There are two reasons why this is the case. The first being that Delta 9 remains illegal in that state and Delta 8 is too close for comfort for them and the other being that Delta 9 is legal in that state & they don’t want to lose out on the tax benefits it brings.
